General terms and conditions involving the use of this site and the licenses of individual images granted by traveladdict.be

Please read carefully through these contractual terms before using the web site and before ordering images. If you agree to the terms, please confirm this by clicking on the "Submit" button before submitting your order. If you do not agree, please click on "Reset". In this case you will not be able to complete your transaction. You find these buttons on the order form. In case of abuse or not following these general terms and conditions, juridical steps will be taken in cooperation with Sofam. Should individual provisions of this contract become ineffective, the validity of the contract shall not otherwise be affected.

1 Ownership of the site and of the images.

This web site, the content and all images are the property of traveladdict.be, a business founded by Nicole Lepée. All components of this website and the images are protected by copyright on a worldwide basis. Without express prior approval from traveladdict.be it is prohibited to copy, transfer or save either the entire website or parts thereof, using whatever means.

2 Licensing.

Licensing is effected through acceptance of these conditions (license agreement - by clicking the "submit" button on the order form) and payment of the fees invoiced. On fulfillment of the above requirements, only the person whose name and address is specified in the order receives the non-exclusive right to use the images, subject to the restrictions listed below.

3 Use of images.

As user/licensee you accept liability for the use of the images and absolve traveladdict.be from any third-party claims arising from use of the images. In addition we point out that no copyright or trade mark registrations may be amended, deleted or added to the web site or images.

At every publication of one of our images, you are obliged to write "© name.photographer / traveladdict.be", as mentioned under every image, and mentioned on the invoice.

Permitted:
-Cover magazines, as illustration for articles in magazines, newsletters and newspapers, advertising and publicity materials, advertising brochures, publications, sales presentations, marketing, displays, leaflets, etc.
-Calendars, postcards and posters
-Web sites: only if the images are used as an illustration and they can't be downloaded.
-The use of the images for personal use.

Not permitted:
-Images may not be leased or transferred to other persons or organizations in any form (i.e. compilations, compositions, icons) without our consent; no copies may be produced or image rights assigned.
-You may not make negatives or slides of the digital files.
-You are obliged to ensure that the images are not used in association with or for the production of pornographic, obscene or other degrading depictions. Nor can they be used for political propaganda. Laws for the protection of individuals must also be observed, as must the Belgian Press code.

For all uses other than mentioned above, you have to contact traveladdict.be.

4 Duration of the contract.

The license is issued for an indefinite period. The contract shall expire without notice in the event of breach of the terms on your part, filing for bankruptcy and in the case of debt composition. Upon termination of the contract, you shall be obliged to destroy the images and any copies made (including those saved on hard drives and back-up disks).

5 Warranty.

In the event that images or media on which the images are recorded are damaged, we reserve the right to rectify faults / arrange substitute delivery. This is subject to the material being returned within 30 days from receipt and with a written description of the defects.

No warranty is accepted for cost-free, defect-free and interruption-free operation of the website.

We shall not be held liable for direct or indirect loss of any kind caused by use of the images or other content.

6 Data protection.

In order to process your orders or provide services, we require certain personal data from you. This information may include company, contact name, address, telephone number, fax number, e-mail address, TVA number and your own web site name. We guarantee that this data will only be used to perform the transaction requested and for our own internal database. You acknowledge that the nature of the Internet entails that this information may pass through different countries and jurisdictions, and give your consent on this matter.

7 General selling terms traveladdict.be

1) traveladdict.be is a company situated in Belgium, Kardinaal Mercierplein 17 bus 4, 2500 Lier. traveladdict.be sells amongst other own images to professionals only. By "professionals" is meant: all natural persons or juridical persons who obtains the rights on the images for professional use defined in the 6th paragraph.

2) The alliances between traveladdict.be and the clients are ruled by the present general terms and conditions, which are ought to be known and accepted. The fact that the client has not received the general terms and conditions in his own language, doesn't make them less valid. Clients who operate from any other country than Belgium, have to be aware that there might be some terms or conditions that do not concern them, but the totality of the terms and conditions are nevertheless valid. traveladdict.be has the right to make changes to the general terms and conditions, without giving personal notice to each client individually, therefore the client has no right to make a claim if a change has been made. The client himself/herself has to check for changes.

3) The period of delivery is given by approximation, there is no warranty given by traveladdict.be. Occurring delay can't possibly cause the right to put a claim or to cancel the agreement.

4) Transportation is on the client's risk and cost, regardless the capacity of the person charged with the transport. The client bears the risk as soon as the products have left the registered office or the depot of traveladdict.be.

5) The following is only valid for deliveries in Belgium: traveladdict.be delivers the articles ordered by the client cash on delivery in alliance with the Belgian Post. Transportation and delivery cost is 10 euro and are on the client's behalf. The delivery will be made by "De Post" during office hours. In case of absence, you will have the opportunity to pick up the delivery at the post office during 2 weeks. The amount you owe traveladdict.be has to be given to the post man in cash or by post cheque. For deliveries in all other countries than Belgium, transportation possibilities and costs will be discussed and formally written down in advance.

6) The client obtains by payment of the amount given on the invoice a non-exclusive, nontransferable and personal right of use of the image. This use involves the reproduction as well as the announcement to the public of the image. By ordering on the Internet site of traveladdict.be, the client accepts the restrictions and terms for the use of the image given by traveladdict.be. The delivery of the image(s) by traveladdict.be does not involve any other transaction of intellectual rights than the right of use mentioned in the paragraph above. These rights are the property of traveladdict.be and the client submits not to violate these rights.

7) Complaints, under penalty of nullity, are only sustainable under the condition that they are addressed to traveladdict.be per certified mail, within three working days after delivery.

8) traveladdict.be is not responsible for the loss of the material and/or other damage of any kind, that the client or a third person could suffer due to a.o. the transportation, the delivery, the depot, the rooms, the use of the products delivered. Meaning the damage to the material, the places, the rooms, the data and the software owned by the client or to a third person, also the loss suffered by exploitation and physical damage without limits. traveladdict.be informs the client that the site can contain links or hyperlinks to other sites. The client accepts that it is not possible to file a claim against traveladdict.be concerning content of a linked site or involving any product or service a linked site refers to. A linked site is owned by an operator independent from traveladdict.be.

9) Should any of these present terms and conditions be invalid or be ineffective, the validity of the other terms and conditions shall not otherwise be affected and this particular term or condition will be of use in the way the law allows it to.

10) The client accepts electronic evidence.

11) Disputes concerning the contract, the validity of the contract, the interpretation or the execution of the contract or of the present terms and conditions fall under Belgian law and are the exclusive competence of the Courts of Bruges.
